Combating human trafficking is a constant and long-term political task of the Vietnamese Party and State. To meet the requirements of the new situation, on February 9, 2021, the Prime Minister approved the programme on preventing and combating human trafficking for the 2021-2025 period, with a vision towards 2030. On that basis, ministries, agencies and localities have been seriously and actively implementing the tasks and solutions under their jurisdiction.

Aggressive measures

The most notable effort in the fight against human trafficking recently has been the introduction of legal documents related to human trafficking prevention and combat. Specifically, with the promulgation of Government Decree 20/2021/NĐ-CP, dated March 15, 2021, as well as a circular by the Minister of Labour, Invalids and Social Affairs guiding the implementation of said decree, the allowance for victims of human trafficking has been increased in order to meet their actual needs. On April 22, the Ministry of Public Security issued a circular stipulating the responsibility of the people’s public security force in carrying out some friendly criminal proceedings when handling reports on crimes of abuse against people under 18.

Concerning the prevention of human trafficking in the field of sending Vietnamese workers abroad, along with the introduction of the 2020 Law on Vietnamese Guest Workers, a range of documents guiding its implementation have also been issued. Under a Government decree, the licence of a guest worker service provider will be revoked if it takes advantage of the overseas dispatch of workers to engage in human trafficking, exploitation or forced labour. The acts of taking advantage of the overseas dispatch of workers to engage in exploitation and forced labour that are not sufficient for criminal prosecution will be heavily penalised under Government Decree 12/2022/NĐ-CP, dated January 17, 2022, on administrative fines in the fields of labour, social insurance, overseas dispatch of Vietnamese workers. The Ministry of Labour, War Invalids and Social Affairs’ Circular No. 21/2021/TT-BLDTBXH, dated December 15, 2021, also specifically stipulates the ceiling of service fees collected from employees for a number of industries, occupations, specific jobs to prohibit enterprises from illegally collecting fees from employees, with some industries in each market not being allowed to collect service fees.

Regarding the prevention and combat of human trafficking, there are a number of other important documents such as: the Government’s Resolution No. 28/NQ-CP, dated March 3, 2021, on promulgating the National Strategy on Gender Equality for the 2021-2030 period, under which the Ministry of Public Security has been assigned to assume the prime responsibility for developing, implementing and reporting on the results of implementation of tasks and solutions on human trafficking prevention and combat; the programme on  protecting and supporting children to interact healthy and creatively in the online environment for the 2021-2025 period (Prime Minister’s Decision No. 830/QD-TTg, dated June 1, 2021), which aims to take action to prevent and detect acts of abuse against children in the online environment, handle acts of taking advantage of the online environment to commit prohibited acts against children in any form according to the provisions of law; and the programme on the prevention and reduction of child labour for the 2021-2025 period, with orientation to 2030 (Prime Minister’s Decision No. 782/QD-TTg, dated May 27, 2021), in which one of the programme’s solutions and tasks is to prevent and combat crimes of child trafficking for the purpose of labour exploitation.

In order to prevent the risk of human trafficking in international migration, especially in illegal migrant activities, on March 20, 2020, ministries, sectors and localities continued with the strict implementation of the United Nations Global Compact for Safe, Orderly and Regular Migration plan (Decision No. 402/QD-TTg of the Prime Minister). Vietnam is currently preparing a dossier of accession to the Protocol against the Smuggling of Migrants by Land, Sea and Air, supplementing the UN Convention on Transnational Organised Crime in 2000. This is an effort to prevent the risk of human trafficking through criminal activities through the smuggling of migrants (although the two forms of crime are different). 

In addition, inter-sectorial coordination has also been maintained and consolidated under the close and timely direction of the Government's steering committee for crime prevention and control (Steering committee 138). Regarding the prevention and combat of human trafficking, in addition to the working mechanism of Steering committee 138, the Ministry of Public Security has established an interdisciplinary working group to implement the programme on human trafficking prevention and control for the 2021-2025 period, with a vision to 2030.

In particular, on July 18, 2022, in response to the World Day Against Trafficking in Persons and the Vietnam’s Day against Human Trafficking (July 30), the Ministry of Labour, Invalids and Social Affairs, Ministry of National Defence, Ministry of Public Security and the Ministry of Foreign Affairs signed Regulations on coordination in receiving, protecting and supporting victims of trafficking.

This is an important milestone, affirming the common efforts and determination in the prevention and combat of human trafficking, protecting the legitimate rights and interests of trafficked victims, overcoming limitations and obstacles in practical coordination in receiving, protecting and supporting victims.

The promulgation of the Regulation has conveyed a strong message about Vietnam's commitment to further improve the effectiveness of human trafficking prevention and combat.

During the COVID-19 pandemic, despite the complicated developments of the disease, which had certain impacts on the implementation of the prevention and combat of human trafficking, Vietnam had many solutions to adapt to the situation. In particular, in order to ensure the progress of settlement and trial of all kinds of cases (including human trafficking cases), the Supreme People's Court has requested courts at all levels to schedule trials and settle cases even on Saturdays and Sundays to ensure progress and time limit for settlement; to rent meeting rooms and arrange trial rooms to satisfy all conditions in case there are not enough meeting rooms or trial rooms; give priority to trial and settlement of cases that are prepared for the expiration of the time limit for trial and settlement. In particular, on the basis of the proposal of the Supreme People's Court, the National Assembly issued Resolution No. 33/2021/QH15 dated November 12, 2021 on organising an online trial (effective from January 1, 2022).

Achieved results

 The fight against human trafficking has been drastically implemented by Vietnam and has achieved positive results.

  • Statistics show that from 2015-2020, the functional forces have detected nearly 1,300 incidents of human trafficking with nearly 1,700 offenders who cheated and sold nearly 3,000 victims.
  • The Government's anti-trafficking programme in the 2016-2020 period has been effectively implemented, reducing over 40% of human trafficking cases compared to the previous period.

  • In the first six months of 2022 alone, Vietnamese functional forces detected and investigated 33 cases, with 75 offenders of human trafficking (according to Articles 150 and 151 of the Criminal Code); in which 17 incidents have finished investigation and transferred to the People's Procuracy for prosecution; one incidents of temporary suspension of investigation. The 66 victims received, verified, rescued and supported.

The programme on human trafficking prevention and control was carried out effectively, reducing >40% of human trafficking cases from the previous period.

 In addition, the ministries, agencies, organisations and localities have promoted the work of receiving and supporting victims of human trafficking. Notably, the Ministry of Labour, War Invalids and Social Affairs has maintained and improved the efficiency of the National Child Protection Hotline No. 111, which is also the hotline for advising and supporting victims of human trafficking.

The Ministry of Public Security, the Ministry of National Defence and the Ministry of Foreign Affairs directed functional agencies to verify, receive, provide initial support and implement safety protection measures for the victims. The Vietnam Women's Union (VWU) Central Committee also received, counselled, gave healthcare, and provided vocational training support for victims at the “Peaceful house” model. After receiving victims, the functional forces and local authorities coordinated together to protect, hand over and provide information and related support services such as subsidies, vocational training, jobs and medical examination and treatment. Vietnam has been continuing to carry out the programme on supporting victims of human trafficking during 2021-2025, with orientation to 2030 according to the Prime Minister's Decision No. 193/QD-TTg, dated February 9, 2021. 

In order to contribute to improving the capacity of officials and employees on duty to prevent and combat human trafficking, many specialised training courses have been held on the law and the work of prevention, detection and handling of human traffickers as well as the protection of victims. 

The activities related to prevention and control of human trafficking have been flexibly integrated into programmes on crime and social evil prevention and control, poverty reduction, vocational training, job creation, gender equality, and child protection, as well as other socio-economic development projects, towards achieving the best possible effect.

 International cooperation in human trafficking prevention and control

 Over the recent years, international cooperation regarding human trafficking prevention and combat has received significant attention and has achieved many positive results. Ministries, sectors and localities have actively provided advice and effectively implemented bilateral and multilateral cooperation agreements on the prevention and combat of human trafficking. The recommendations of the foreign sides related to the prevention and control of human trafficking have been carefully and thoroughly considered by Vietnam. Many recommendations have been included in the Human Trafficking Prevention and Control Programme for the 2021-2025 period with a vision to 2030.

Currently, the Ministry of Public Security is working with other ministries and sectors to complete a statistical form on the prevention and combat of human trafficking. In the process of building the form, the Ministry of Foreign Affairs has also been actively developing statistical criteria according to international practices for ministries and agencies to refer to and adjust to suit their practices. The upcoming completion and synchronous implementation of the statistical form will help in fully assessing the efforts to prevent and combat human trafficking so that we can determine appropriate policies.

Specifically, in recent times, Vietnamese authorities have increased cooperation with foreign parties in verifying, identifying and protecting victims of trafficking. The Ministry of Foreign Affairs has promptly directed overseas Vietnamese representative missions to closely monitor the situation of Vietnamese citizens in the host countries to detect human trafficking trends and issues related to citizens in a timely manner, especially in the rescue and protection of victims, thereby supporting prosecution and trial work in Vietnam.

Most recently, at the end of June and beginning of July 2022, the Ministry of Foreign Affairs coordinated with the Ministry of Defence to rescue and bring back seven citizens who were trafficked to Cambodia for forced labour, contributing to thoroughly solving this situation because the sending of Vietnamese people to Cambodia for forced labour is emerging and becoming a sore problem that is seriously affecting human rights.

Tasks set for the coming time 

The facts have shown that Vietnam's efforts and determination in the fight against human trafficking are undeniable. Facing the increasingly complicated situation of cross-border human trafficking, it is required that the fight against human trafficking crimes should be further promoted. Accordingly, it is necessary to mobilise the synchronous participation of the entire political system and functional agencies, as well as the engagement of the community, while strengthen inter-sectoral coordination and international cooperation in the prevention and control of human trafficking.

Functional forces, in which the people's public security forces and the border guards play a key role, continue to grasp the situation and quickly detect unusual problem in their areas in order to take timely measures to handle them. The Steering Committee for Prevention and Combat of Crime and Social Evils and Building of the movement on all people united to protect national security at all levels should pay greater attention to accelerating the implementation of the movement in key and strategic areas as well as the living areas of religious practitioners and ethnic minority groups.

It is also necessary to step up communication activities regarding human trafficking prevention and control, which should be implemented in more diverse ways to reach wider audience and provide them with regular updates on the methods and tricks of human traffickers. The communication activities should be accelerated in villages and hamlets, especially in mountainous, remote and isolated areas, so that people are provided with enough information and increased vigilance against human trafficking. 

The synchronous participation of the government, relevant authorities and the community will help to prevent and address the crime of human trafficking in Vietnam.
